“if.fm” non dichiara né garantisce che: a) l’utilizzo dei servizi soddisfi le esigenze dell’utente; b) l’utilizzo dei servizi sia tempestivo, ininterrotto, sicuro o privo di errori; c) ogni informazione ottenuta dall’uso dei servizi sia precisa e affidabile; d) siano assenti difetti nell’utilizzo e nelle caratteristiche funzionali di qualsiasi software fornito come parte dei servizi. “if.fm” si riserva il diritto di attuare in qualsiasi momento la modifica delle presenti condizioni d’uso. L’utente che utilizzerà i contenuti di “if.fm” successivamente a tale modifica accetterà tacitamente il loro contenuto rinnovato; ciascun utente di “if.fm” dovrà visionare la pagina delle condizioni generali per accertarsi della presenza di eventuali modifiche o aggiornamenti.

I rapporti tra “if.fm” e l’utente, unitamente alle presenti condizioni generali, sono regolati dalla legge italiana. Per ogni controversia relativa alle presenti condizioni sarà competente il Foro di Savona. Nel caso in cui “if.fm” non esercitasse i propri diritti o le azioni giudiziali di cui beneficia, ciò non integrerà una rinuncia agli stessi, i quali saranno sempre disponibili. “if.fm” potrà inviare ogni comunicazione al proprio utente tramite invio di posta elettronica, posta ordinaria, o con comunicazioni pubblicate sul proprio sito Internet.

La piattaforma “if.fm” non è strumento per la divulgazione di materiale o di collegamenti lesivi dell’onore, della reputazione e della sfera personale degli individui o motivo di discriminazione di qualunque genere. “if.fm” non è nemmeno spazio per l'inserimento di materiali che valichino il comune senso del pudore e della morale, celebrativi di situazioni di dissolutezza morale, di carattere sessualmente esplicito, oppure aventi ad oggetto scene dirette di estrema violenza, morte, maltrattamenti, omicidio o scene di vessazione psico-fisica.

Si ribadisce che ogni contenuto inserito o condiviso tramite i link abbreviati non è di proprietà di “if.fm”; il sito e i suoi titolari e/o gestori non sono in alcun modo identificabili con l’autore dei testi, dei filmati, delle fotografie e di qualunque altro contenuto presente sulla pagina per il cui URL è stato creato uno "short link". “if.fm” e i rappresentanti disapprovano e si dissociano recisamente da ogni violazione della privacy e del copyright, da ogni atto di intimidazione, molestia, rivelazione di informazioni e dati personali, nonché da ogni contenuto illecito, lesivo, dannoso, molesto, abusivo, diffamatorio, volgare, osceno, razzista, in particolare nei confronti di minori.

“if.fm” contrasta lo spam, i contenuti ripetitivi ed indesiderati aventi mere finalità pubblicitarie e promozionali. In caso di reiterazione di violazioni da parte di un utente, “if.fm” si riserva di impedire l’utilizzo del relativo account, provvedere all’eliminazione di tutti i contenuti caricati ed impedire al responsabile la creazione di un nuovo account.

Tutela della riservatezza

Il sito “if.fm” garantisce a tutti gli utenti il massimo rispetto della normativa in materia di trattamento dei dati personali, disciplinata dal codice della Privacy di cui al D.Lgs. n. 196 del 30/06/03. Le comunicazioni via email agli utenti verranno inviate solo dietro esplicito consenso dell’utente stesso, rilasciato unitamente all’autorizzazione al trattamento ed all’invio nel modulo di registrazione online.

1 – Modalità trattamento dati

– del diritto dell’interessato di chiedere al titolare l’accesso ai dati personali (art. 15 Regolamento UE), il loro aggiornamento (art. 7, co. 3, lett. a) D.Lgs. 196/2003), la rettifica (art. 16 Regolamento UE), l’integrazione (art. 7, co. 3, lett. a) D.Lgs. 196/2003) o la limitazione del trattamento che lo riguardino (art. 18 Regolamento UE) o di opporsi, per motivi legittimi, al loro trattamento (art. 21 Regolamento UE), oltre al diritto alla portabilità dei dati (art. 20 Regolamento UE);
– del diritto di chiedere la cancellazione (art. 17 Regolamento UE), la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati (art. 7, co. 3, lett. b) D.Lgs. 196/2003);
